TERMS AND CONDITIONS

1. IDENTIFICATION AND OWNERSHIP

This document governs the purchase of products and services through tienda.foredu.es, owned by FOREDU SOLUTIONS, S.L. (hereinafter, FOREDU), with Tax ID (CIF) B98749104 and registered address at C/ Mariano Benlliure, 62, 46183 l'Eliana (Valencia), Spain. Email: info@foredu.es

2. PURPOSE AND ACCEPTANCE

The purchase of any product implies full acceptance of these terms and conditions. FOREDU reserves the right to cancel any order for security reasons, detected fraud, or obvious typographical errors in the product price or description.

3. PRICES AND AVAILABILITY

  • Typographical Errors: If a product is listed with an incorrect price due to a technical or human error, FOREDU will inform the customer and reserves the right to cancel the order at no cost, refunding the full amount paid..
  • Availability: All orders are subject to stock availability. If a product is unavailable after purchase, the customer will be informed and offered either a similar product or a full refund.

4. SHIPPING AND TRANSPORT LIABILITY

  • Delivery Times: Estimated delivery times of 24–120 hours are indicative only. FOREDU shall not be liable for delays caused by force majeure or operational failures of the transport company.
  • Inspection Obligation: The customer is legally required to inspect the condition of the package upon delivery
    • External Damage: If the package shows visible damage (impacts, moisture, broken seal), the customer must note this on the carrier’s delivery note or refuse the shipment.
    • Internal Damage: Any internal damage must be reported to FOREDU within a maximum of 24 hours from receipt so that a claim can be filed with the transport insurance. After this period, FOREDU cannot be held liable for physical damage.

5.RIGHT OF WITHDRAWAL (RETURNS)

In accordance with current regulations, the consumer has 14 calendar days to withdraw from the purchase by completing the corresponding form.

  • Product Condition: To be eligible for withdrawal, the product must be returned in its original condition, with all accessories and packaging intact.
  • Depreciation: If the product has been handled beyond what is necessary to verify its nature or functionality, or if the original packaging is damaged (e.g., due to seals or stickers), the customer shall be responsible for any depreciation in value.
  • Exclusions: Returns will not be accepted for unsealed software, opened hygiene products, or services already performed.

6. WARRANTY POLICY

FOREDU acts as the seller and is responsible for lack of conformity under the following terms:

  • End Consumer (Families): Legal warranty of 3 years. During the third year, the burden of proof regarding the origin of the defect lies with the consumer (Art. 121 TRLGDCU).
  • Professional/Business Customer (B2B): Limited warranty of 1 year in accordance with the Commercial Code
  • Total exclusions: The warranty is void in cases of:
    1. Misuse, impacts, drops, or exposure to moisture/liquids.
    2. Tampering with warranty seals or software by unauthorized personnel.
    3. Damage caused by electrical surges or natural disasters.
    4. Normal wear and tear of consumables (e.g., batteries, screens after prolonged use).

7. LIMITATION OF LIABILITY

FOREDU shall not be liable for:

  • Loss of information or data on devices submitted for warranty service. It is the customer’s responsibility to make backups.
  • Indirect damages, loss of profits, or loss of business opportunities resulting from delivery delays or defective products.

8. DATA PROTECTION

Personal data will be processed in accordance with the GDPR solely for the purpose of managing the contract, shipping, and after-sales support. The customer may exercise their rights of access, rectification, and erasure by emailing info@foredu.es .

9.APPLICABLE LAW AND JURISDICTION

This contract is governed by Spanish law.

  • In the event of a dispute with a consumer, the courts of the consumer’s place of residence shall have jurisdiction.
  • In the event of a dispute with a company or professional, both parties expressly waive their own jurisdiction and submit to the Courts of Valencia.
